Anyone suspected of being an undocumented immigrant will be taken into the custody of the Immigration and Customs Enforcement Agency (ICE). While their case is being prepared and heard, they can leave the immigration center upon the attainment of an immigration bond.
The immigration bond works in the same way as many other legal bonds. An officer will decide if the person in question can obtain a bail bond. They may then leave the center and return for their hearing or trial.
There are two main types of immigration bonds. They are the delivery bond and the voluntary departure bond.
The delivery bond can be granted to anyone who has gained an arrest warrant from the ICE. It acts as a standard bail programme that anyone may use when arrested. The specified bond ensures that the payee returns for any further proceedings.
These proceedings may include further hearings and the final immigration verdict. In the time between, they may resume their normal life. Specialist immigration lawyers deal with these proceedings.
Voluntary Departure Bond
The voluntary departure bond is slightly different. This is for undocumented aliens who have already have the verdict of deportation from the country. In some cases, they can leave voluntarily in a time frame specified by the court.
The departure bond allows people to close any businesses, bank accounts, accommodation and wrap up their affairs. If they leave the country by the specified date, then the bond gets returned to them. If they do not, the court keeps the bond.
Bail Bonding Agents
The average bond can be obtained in two ways. The first is by paying is hard currency in the form of cash, money orders and cheques. It can be obtained by the person on bail or from friend and families donations or loans.
The second is to hire a bail bonding agent. The bonding agent will provide the amount, making 10-20% of the bond amount as commission. A lien must be offered on collateral prepared by family, friends and the person taking out the bond.
How Much Is a Bond?
Depending upon the individuality of the case, the average delivery bond will be set between the ICE and an immigration lawyer. They can fall from anywhere between $1500 dollars to $10,000. Factors taken into account are employment, family ties and any former criminal history.
